We at INDEX Berlin take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the legal regulations of the relevant data protection laws, in particular the European Data Protection Regulation (GDPR) and this privacy policy.

This privacy policy covers the use of INDEX Berlin's digital offerings, including our social media profiles, via PC, smartphones, tablets and all other Internet-enabled mobile devices.

Purpose of the processing of personal data
1. Logfiles

Every time our websites are accessed, usage data is transmitted by the respective internet browser and stored in log files, the so-called server log files. The data records stored in this process contain the following data: Browser type and browser version, operating system used, referrer URL, time of server request, abbreviated IP address.

These data cannot be assigned to specific persons. A consolidation of this data with other data sources is not carried out. We reserve the right to check this data subsequently if we become aware of concrete indications of illegal use.

The basis for data processing is Art. 6 para. 1 s. 1 lit. f GDPR, which permits the processing of data to safeguard the legitimate interests of the data controller, unless the interests or fundamental rights and freedoms of the data subject outweigh the processing.

2. Data processing for communication with you

We process your communication data (name, address, telephone number, e-mail address) in order to process your enquiry and/or to be able to contact you. Personal data that you provide us with by e-mail will only be processed for correspondence with you or for the purpose for which you have provided us with the data.

If you would like to contact us, the website gives you the opportunity to open an e-mail addressed to us with just one click. The sender is automatically the e-mail address linked to your e-mail program. If you do not want your e-mail address to be retrieved in this way, you can change this in the settings of your e-mail program. We process your data to communicate with you and to reply to your message.

The basis for data processing is Art. 6 para. 1 sentence 1 letter b GDPR, which permits the processing of data for the fulfilment of a contract or pre-contractual measures.

3. Newsletter MailChimp

With your consent, you can subscribe to our newsletter, with which we will inform you about current interesting news, exhibitions and other events. If you would like to receive the newsletter offered by us, we need an e-mail address from you as well as information that allows us to verify that you are the owner of the e-mail address provided and that you agree to receive the newsletter. For this purpose, we will send you an e-mail to the e-mail address provided with a confirmation link (double-opt-in). If you do not confirm your registration within 24 hours, your information will be blocked and automatically deleted after one month.

Your e-mail address is the only mandatory information for the sending of the newsletter. The provision of further, separately marked data is voluntary and is used to address you personally. In addition, we store your IP address and the time of registration and confirmation. The purpose of this procedure is to be able to prove your registration and, if necessary, to clarify any possible misuse of your personal data. We do not collect any other data in this context. We use these data exclusively for sending the requested newsletter. As far as we use a processor to send the newsletter, we will of course comply with the applicable data protection laws.

For sending newsletters we use the services of MailChimp. Provider is the Rocket Science Group LLC, 675 Ponce De Leon Ave NE, Suite 5000, Atlanta, GA 30308, USA. With MailChimp the sending of newsletters can be organized and analyzed. If you enter data for the purpose of receiving newsletters (e.g. e-mail address), this data is stored on the servers of MailChimp in the USA.

With the help of MailChimp we can analyze our newsletter campaigns. When you open an e-mail sent with MailChimp, a file contained in the e-mail (so-called web-beacon) connects to the servers of MailChimp in the USA. This way it can be determined whether a newsletter message was opened and which links were clicked on, if any. Technical information is also collected (e.g. time of retrieval, IP address, browser type and operating system). This information cannot be assigned to the respective newsletter recipient. It is used exclusively for statistical analysis of newsletter campaigns. The results of these analyses can be used to better adapt future newsletters to the interests of the recipients.

If you do not want to receive analysis by MailChimp, you must unsubscribe from the newsletter. For this purpose we provide a link in every newsletter message. You can also unsubscribe directly on the website.

Important in connection with data processing in the USA: According to the European Court of Justice, the data protection standard in the USA is insufficient and there is a risk that your data will be processed by US authorities, for control and monitoring purposes and possibly without any possibility of legal recourse.

The data you provide us with for the purpose of subscribing to the newsletter will be stored by us until you unsubscribe from the newsletter and will be deleted from our servers as well as from the servers of MailChimp after you unsubscribe from the newsletter. Data that has been stored for other purposes remains unaffected.

The data processing takes place on the basis of your consent in accordance with art. 6 para. 1 sentence 1 lit. a GDPR and Art. 49 para. 1 s. 1 lit. a GDPR. You can revoke your consent to the sending of a newsletter at any time and cancel the respective subscription. You can revoke your consent by clicking on the link provided in each e-mail. The legality of the data processing operations that have already taken place remains unaffected by the revocation.

4. Cookies

We use so-called cookies on some of our Internet pages, among other things in order to be able to offer you website-specific services, to be able to recognise you on a repeated visit to our website, and/or to be able to adapt our offer to your personal preferences.

Cookies are small text files that are stored on a visitor's computer and contain data on the respective user to enable access to various functions. 5. Tracking with Google Analytics

The provider of this site has no influence on this data transfer. 7. Data processing in the context of our Facebook corporate website

We operate a company page (fan page) in the social network facebook.com. We are jointly responsible with Facebook for the operation of the Facebook fan page within the meaning of Art. 26 GDPR. Primarily responsible for data processing is Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland ("Facebook").

Facebook provides us with so-called page insights for our site. Page-Insights (https://www.facebook.com/business/a/page/page-insights) are aggregated data that allows us to understand how people interact with our site. The creation and provision of these page insights is the responsibility of Facebook, we have no influence on it. 8. Data processing within the scope of our online presence at Instagram

We have an online presence with Instagram, a platform of Facebook Ireland Ltd., 4 Grand Canal Square, Dublin 2, Ireland, to communicate with you and keep you informed of news. In addition to our interaction with you, Instagram processes data from visitors to its websites for the purposes of market research and advertising, i.e., a user profile may be created by the social network operator based on the visitor's visit or usage behavior and the preferences and interests of the visitor. Such user profiles may be used, among other things, to display advertisements within Instagram and possibly on other websites to users individually adapted to the respective user profile. Cookies (see above) may be stored on visitors' devices to collect data on user behavior. The collection of this data, especially for logged in members of the respective social network, can also be realized across several browsers and/or devices used by a user. Even if a visitor does not have a profile with Instagram, it cannot be ruled out that personal data on this visitor may be stored when visiting the respective website. 9. App

In addition to our web presence we offer an app for mobile devices. In order to install the app, you may need to enter into an agreement with a third party (e.g., iOS App Store, Google Play Store) to access a portal or online store of that third party.

INDEX Berlin is not a party to such an agreement and has no influence on the data processing by the third party provider. Which data is processed and in which way during registration with the online shop can be seen in the data protection declaration of the third party provider. The download from the online shop is purely voluntary. The app itself is free of charge, but we would like to point out that connection costs may apply. A network connection is required for some services of the app. The app retrieves this status. This status is not saved.

The app uses push services of the operating system manufacturers. These are short messages that are shown on the display with your consent and with which you are actively informed about news from us. If you use the push services, a device token from Apple or a registration ID from Google will be allocated. The sole purpose of their use by us is to provide the Push Services. These are only encrypted, anonymised device IDs. Any inference to your data is excluded. If you do not want this functionality of the app, you can adjust your device settings accordingly. To unsubscribe the push messages, you can use the unsubscribe option in the app under Settings/Notifications. There the user can activate and deactivate push messages.

In addition, the receiving of push messages can also be switched off via the operating system.

Anonymous cookies are used to maintain sessions within the app. These cookies expire after using the app and do not allow any conclusions about your identity.

When using the app, there is no determination of the user's location based on the sensors of the end device (e.g. via GPS, mobile phone masts or WLAN).

Personal data is only processed within the scope of using the App in order to be able to offer you the use of the App and App-specific services.

10. Data processing to protect legitimate interests

We also process your data if it is necessary to protect the legitimate interests of us or third parties. This may be the case in particular to ensure IT security and IT operation, in particular also for support enquiries, to be able to understand and prove facts in the event of legal disputes, for market and opinion surveys, to statistically evaluate the use of our website, for advertising other products from us or our cooperation partners.

12. Categories of recipients of the personal data

Your personal data will only be passed on or otherwise transferred to third parties if this is necessary or if you have given your prior consent or if there is a legal basis for the transfer.

Service providers who support us in providing our services to you are sales and marketing partners, software (SaaS) providers, IT service providers, especially service providers for software and hardware maintenance, hosting providers and e-mail service providers.

13. Duration of data storage

In principle, we delete your data as soon as they are no longer required for the above-mentioned purposes, unless temporary storage is still necessary.

15. Data security

Your personal data is securely transmitted by us using encryption. We use the SSL (Secure Socket Layer) coding system for this purpose. You can recognise an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser line. Furthermore, we secure our websites and other systems by technical and organizational measures against loss, destruction, access, modification or distribution of your data by unauthorized persons.

16. Rights of data subjects

Within the framework of the applicable legal provisions, you have the right to obtain information free of charge at any time about your personal data stored by us, its origin and recipients and the purpose of the data processing and, if applicable, a right to correct, block or delete this data. Zweck der Verarbeitung personenbezogener Daten
